Terms of Service
Effective date: [DATE]
These terms are a contract between you and Chris Morrell ("we," "us"), which runs chris.club ("Chris Club" or the "site"). By creating an account, paying a fee, or using the site, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the site.
Please read section 17. It requires most disputes to go to individual arbitration and waives class actions.
1. What Chris Club is
Chris Club is a novelty website for people named Chris. Verified members get a numbered page (for example, chris.club/42) and can take part in features like badges, certifications, and the web ring.
Chris Club is for fun. Membership has no value outside the site. It is not an investment, a collectible with resale value, a credential, or proof of identity for any other purpose.
2. Who can join
To become a member, you must:
- Be at least 18 years old.
- Live in the United States and have a valid, unexpired US government-issued photo ID.
- Have a legal given name (first or middle name) that appears on our list of accepted Chris names, as shown on your ID.
- Have only one membership. One person, one Chris.
We decide which names count as "Chris." We may change the list at any time, but changes won't remove anyone who is already verified.
3. Your account
You must give accurate information and keep your password safe. You are responsible for activity on your account. Tell us right away at [email protected] if you think someone else has used it.
4. ID verification
- We use Stripe to verify your ID. Stripe Identity checks your government ID and a selfie to confirm your identity. Stripe's process is covered by its own terms and privacy policy. See our Privacy Policy for what we receive and keep.
- You get one attempt. If verification fails for any reason, or your verified given name is not on our list, you are permanently disqualified. You cannot try again with the same or a new account.
- The verification fee is non-refundable, whether you pass or fail. The fee pays for the verification attempt itself.
- We may decline or revoke membership if we believe someone verified using an ID that isn't theirs or otherwise cheated the process.
5. Prices and payment
- All prices are in US dollars and shown before you pay. Current prices:
- Verification fee: $2.50. Covers one ID verification attempt and, if you pass, a free member number.
- Premium numbers: prices are shown on the upgrade page before checkout, based on the number range and whether the number is a special number.
- Prepaid nominations: $2.50. Covers one verification attempt for the person you nominate.
- Stripe processes all payments. We never see or store your full card number. Stripe is certified to PCI Service Provider Level 1, the highest level of payment industry security certification.
- All purchases are one-time charges. There are no subscriptions or recurring charges, so there is nothing to cancel.
- You are responsible for any taxes that apply, unless we collect them at checkout.
6. What you get
- Delivery. Everything we sell is digital and delivered on the site. Your number is usually assigned within a few minutes of a successful verification or payment. If it isn't assigned within 24 hours, contact us.
- Free numbers are assigned in order, starting at 1001. You can't choose a free number.
- Premium numbers. You can buy the next open number in a premium range, or a specific open number. When you buy a new number, your old number is retired and never reassigned. Links to your old number will redirect to your new one.
- License, not ownership. A member number and page are a limited, personal, non-transferable license to use that number on Chris Club while these terms are in effect. You don't own the number or the page. You may not sell, transfer, or rent them.
- We may change how pages, numbers, URLs, or features work. We will not take away a number you paid for except as these terms allow (sections 8 and 13).
7. Refunds
All fees are non-refundable, except:
- If we charge you by mistake or charge you twice, we will refund the extra charge.
- If you pay for a premium number and we can't give it to you (for example, someone else got it first), we will refund you automatically and you keep your current number.
- If we can't deliver what you paid for within 7 days because of a problem on our side, we will refund you.
- Where the law requires a refund.
To ask for a refund, email [email protected] within 30 days of the charge with the email address you used and the date of the charge. Approved refunds go back to your original payment method through Stripe. Your bank may take 5–10 business days to show it.
8. Chargebacks
If you have a problem with a charge, please contact us first. We'll try to fix it quickly.
If you dispute a charge with your bank or card issuer instead, we may immediately revoke your membership and any numbers on your account, and your page may show that the membership was revoked because of a disputed payment. We may contest disputes we believe are invalid. If the dispute is resolved in our favor, we may restore your membership at our discretion.
9. Nominations
- Verified members can nominate people they believe are named Chris. Anyone can nominate someone by prepaying the verification fee.
- Only nominate people you know and believe would want to hear from us. We send the nominee one email with a link to join.
- A prepaid nomination covers one verification attempt. It is non-refundable, including if the nominee never joins or fails verification. It expires 90 days after purchase.
- We may refuse or limit nominations to prevent spam.
10. What is public
The following may be shown publicly on the site, in embeds, in share images, and in search results:
- Your member number.
- Your name, in the format you choose: given name only, given name and last initial, or full name. You can change this at any time.
- Your avatar, badges, certification counts, page hit counts, join date, and whether you've been Chris of the Day.
- Whether your membership was revoked because of a disputed payment (section 8).
Rejections. If you apply and don't qualify, we may show the given name you typed on the site in a humorous way. We may also show other short text we write about a rejection. We will never show your last name, email address, or anything from your ID with a rejection. If you'd like a rejection removed, email us and we'll take it down.
11. Certifications and badges
Certifications ("I certify this Chris is a Chris") and badges are jokes. They are not statements of fact by us or any member, and you shouldn't rely on them for anything.
12. Rules
You agree not to:
- Create more than one account, or verify using someone else's ID.
- Use bots, scripts, or other automated tools to sign up, nominate, certify, or generate page hits.
- Try to get around rate limits, verification, or payments.
- Interfere with the site's security or operation, or try to access data that isn't yours.
- Use the site to harass anyone, send spam, or break the law.
- Scrape the site in a way that burdens it.
13. Suspension and termination
- By you. You can delete your account at any time from your dashboard. Your number is retired and not reassigned. Deleting your account doesn't entitle you to a refund.
- By us. We may suspend or end your account if you break these terms, if we're required to by law, or to protect the site or other members. If we end your account for reasons other than your breaking these terms, we'll refund any premium number purchase made in the prior 90 days.
- Shutting down. We may shut down Chris Club. We'll try to give at least 30 days' notice on the site. Because Chris Club is a novelty, shutting it down does not entitle members to refunds, except where the law requires.
14. Embeds and the web ring
Members may embed our web ring widget on their own websites using the code we provide. You may not change the widget to mislead people. We may change or remove the widget at any time.
15. Our content
We own the site, its design, code, text, and badges, and the Chris Club name. You may not copy or use them except as these terms allow. If you send us suggestions, we may use them without paying you.
16. Disclaimers and limits on liability
- As is. The site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the site will always be available, error-free, or secure.
- Limit on damages. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the site is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $50.
- Some laws don't allow these limits. Where they don't, the limits apply only as far as the law allows.
17. Disputes
- Talk to us first. Before filing any claim, email [email protected] and describe the problem. We'll both try in good faith to resolve it within 60 days.
- Arbitration. If we can't resolve it, any dispute relating to these terms or the site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either of us may bring a claim in small claims court if it qualifies. The arbitrator may award the same relief a court could award on an individual basis.
- No class actions. You and we each agree to bring claims only on an individual basis, not as a plaintiff or class member in any class, group, or representative action.
- Opting out. You can opt out of this arbitration agreement by emailing [email protected] within 30 days of first agreeing to these terms, with your name, email address, and a clear statement that you opt out of arbitration.
- Governing law. These terms are governed by the laws of the Commonwealth of Pennsylvania and the Federal Arbitration Act, without regard to conflict of law rules. For any claim not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts in Philadelphia County, Pennsylvania.
18. Changes to these terms
We may update these terms. If we make a material change, we'll post the new terms on the site and email members at least 14 days before the change takes effect. Continuing to use the site after that means you accept the new terms. Changes don't apply to disputes that arose before the change.
19. General
These terms and our Privacy Policy are the whole agreement between you and us about the site. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not transfer your rights under these terms; we may transfer ours as part of a merger, sale, or similar transaction.
